LA NUEVA MIFID IMPONE RESTRICCIONES A LAS EAFI EN ESPAÑA
El debate está sobre la mesa. Bruselas no ha definido aún si se tratará de una recomendación o bien será una normativa de obligado cumplimiento. Simplemente abrió un periodo de consulta, que ya ha cerrado. Estas empresas empezaron a nacer en el 2009. Realmente solo representan una pequeña parte de los miles de asesores financieros que existian antes de la entrada en vigor de la MIFID.
Uno de los problemas de la actual crisis es que la mayoría de los inversores que han perdido dinero no estaban informados de los riesgos de los productos financieros que compraban y rara vez su perfil inversor coincidía con lo que se les vendía.

En el 2010, asesoraron un patrimonio de 15.852 millones, tanto procedente de clientes minoristas, como de profesionales (fondos e inversores cualificados, con más de 50.000 euros de inversión). La mayor parte del patrimonio asesorado por estas firmas (14.076 millones) procedió de clientes profesionales; mientras que el resto, 1.776 millones, era de minoristas. La media asesorada a particulares asciende a 759.298 euros, ya que se firmaron unos 2.339 contratos.
En España, la colocación y distribución de productos financieros se hace a través del sector bancario; apenas un 5% está asesorado de forma independiente. Mientras que, en países como el Reino Unido o Suiza, la penetración de los asesores independientes se sitúa entre el 70 y el 80%, según fuente del sector. Es muy importante que estas entidades estén reguladas, pero no estranguladas, ya que el exceso de regulación puede hacer inviable su futuro.
Para Javier Kessler, presidente de la asociación del sector, Aseafi, la clave está que se "rompa la asimetría de información entre bancos y clientes finales". A su juicio, estas sociedades han nacido para "eliminar los conflictos de intereses y tienen que ser lo más transparentes posible". Y para que se entienda, Kessler pone un símil: "Usted, cuando acude al médico, ¿prefiere pagar por una buena consulta o que sean los laboratorios quienes pagan sus medicamentos y recomendaciones?". Pues algo así, explica, sucede en banca: "Hay que proteger al cliente final", que, añade, "supone un cambio en toda regla". Estos cambios, cuando lleguen, afectarán también a las agencias de valores y sociedades, es decir, a todas las empresas que prestan servicios de inversión.
La mayor parte de las Eafi pertenece tanto al Consejo General del Colegio de Economistas como a la Aseafi (Asociación de Empresas de Asesoramiento Financiero). Ambas entidades compiten por ser la voz del sector. El futuro y la viabilidad económica de estas sociedades fue debatido en la sede del Colegio de Economistas, lo que, al parecer, produjo cierto malestar en Aseafi.
